Acknowledgement of this form is required for each person joining a passage with Saga47swan Sailing. Please read carefully before agreeing. By agreeing to this Agreement, each person participating in a sailing passage waives all claims against Christian Lobel, Saga47swan Sailing, its servants and any reservation/booking agent for injury, accident, illness or death during or by reason of their joining a passage or trip on the sailing vessel Saga. "I ACKNOWLEDGE that I am aware that during the passage in which I will be participating, certain risks and dangers may arise, including but not limited to, the hazards of travelling on the open sea, falling overboard, storms, high winds, collision of vessels, shipwreck, travel ashore in remote terrain, the forces of nature, and accident or illness in remote regions without means of rapid evacuation or medical facilities. I am also aware and clearly understand that Christian Lobel will have no liability regarding provision of medical care or the adequacy of any care that may be rendered. I have read the Expectations supplied to me by Saga47swan Sailing and agree to abide by these rules on board or ashore, for the duration of the Sailing expedition. I understand that although Saga47swan Sailing may make suggestions as to air carriers and travel agents, they assume no liability for injury, damage, delay, irregularity or loss of baggage relating to airline travel. In consideration of the Agreement with Saga47swan Sailing to participate in this Sailing expedition, I hereby agree that I will assume all risks of this trip and I will not make any claims against Christian Lobel / Saga47swan Sailing or sue for bodily injury, emotional trauma, death and/or property damage resulting from negligence or unseaworthiness of the vessel, or other acts, however caused, as a result of my participation in this expedition. I, therefore, release, indemnify and discharge Christian Lobel & Saga47swan Sailing from all claims, actions and demands that I may have for bodily injury, death or property damage arising from my participation in the expedition" This RELEASE OF LIABILITY, AGREEMENT TO HOLD HARMLESS AND INDEMNIFY, AND ASSUMPTION OF RISK Agreement is entered into on behalf of all members of my family, including any minors accompanying me. If any person who accompanies me on this trip as part of my family makes claim, or if a claim is made on their behalf, my estate or I will indemnify and hold harmless Christian Lobel / Saga47swan Sailing from any loss, including reasonable attorney's fees incurred in the defence of such claim. This Agreement is binding upon my heirs, legal representatives and assigns. If any portion of this Agreement is unenforceable, the remaining portions shall remain in full force and effect. All crew applicants are subject to acceptance by Saga47swan Sailing. This Agreement shall be deemed to have been entered into at Elsinore, Denmark and shall be construed and interpreted according to the laws of Denmark. In the unlikely event a legal dispute should arise, I agree the dispute shall exclusively be brought before the appropriate court in Elsinore, Denmark. I have carefully read this and understand its terms. I execute it voluntarily and with full knowledge of its significance.
Sailing is an active sport and can include potential risks to persons and property. Accidents are very unlikely and rare, but by joining Saga47swan Sailing as crew, crew are deemed to accept that they participate at their own risk and that Christian Lobel, Saga47swan Sailing and its servants do not accept any liabilities whatsoever for any personal injury or for any loss or damage to any personal effects or property in whichever manner this may be caused. All crew will have to sign the “Assumption of Risk” form.
The sailing yacht “Saga” is covered by a fully comprehensive marine insurance, but crew are responsible for their own personal insurance. It is strongly recommended for crew to arrange adequate cover for medical expenses, Evacuation & Repatriation, loss of personal effects, third party liability and cancellation etc.
By paying the first instalment (Deposit) of the “crew contribution” you agree that you have read and understood the following deposit/cancellation policy. Once your application to join as crew has been approved, you'll receive an email with details of the total crew contribution fee. The deposit is due immediately in order to officially reserve your crew space, and is non-refundable. If you give written notice of your cancellation 90 days before departure, you will not be billed for the final balance. If, after you've paid the final balance payment and still decide to cancel for whatever reason, and Saga47swan Sailing is able to re-book your berth, you will receive a full refund. You understand that within 90 days of departure, no refund or credit can be made for any reason including illness. You understand that there are no exceptions to this policy. You understand the importance of trip cancellation insurance, which is your own responsibility to obtain. By accepting the offer of a crew berth and paying the deposit of the “crew contribution” you agree to all of the above.
COVID RELATED ISSUES Vaccines Prior to boarding, you must be able to prove you have the vaccines required for entry into any countries we will visit on the route. Travel insurance There is a great deal of disruption to flights currently. We strongly urge you to take out suitable travel insurance that covers flight cancellation, and to take this out as soon as you have booked with us. Covid insurance We strongly advise you to take out separate insurance. This should cover you for the eventuality that you are in lock down, that you cannot travel, that you test positive for Covid at any point. Covid double vaccination Where border entry rules on international passages require it, all crew joining an event may be required to provide proof of COVID-19 double vaccination prior to departure. We do not discriminate against unvaccinated crew though as a sailing vessel we must follow any laws set down by the health authorities in each country.
